Terms of service

The terms that apply when you use Shufti.

1. Who we are and what these terms cover

These Terms of Service ("Terms") are between you and Frontpoint Digital Pty Ltd (ABN 23 669 870 366) of 7/232 Barkly St, St Kilda, VIC 3182 ("Shufti", "we", "us"), of shufti.io, shufti.com.au and the Shufti mobile app (together, the "Service").

By creating an account, using the guest/no-account path, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service helps you research and inspect a used vehicle before you buy it. It does not sell vehicles, does not act as a dealer or broker, and is not a party to any sale between you and a seller.


2. Not professional advice — read this before you rely on a number

This clause is central to these Terms. Please read it carefully.

Shufti generates estimates using artificial intelligence and automated scoring, based on information you provide (a listing URL, photos, audio clips, and your written answers) and third-party data sources (vehicle recall registers, PPSR searches). This includes, without limitation:

None of this is a mechanical inspection, a professional vehicle valuation, or financial, legal, or professional advice of any kind. It is not a substitute for a qualified, independent, hands-on inspection by a licensed mechanic or vehicle inspector. Shufti has not physically inspected the vehicle. Photos and the descriptions you provide can miss defects that are not visible, not described accurately, or not able to be assessed from an image.

You may use Shufti's output to help inform a decision to buy a vehicle and to help inform your negotiation with a seller, but you make that decision and that offer, and you bear the consequences of it. You should not treat any figure produced by the Service as a guarantee of the vehicle's condition, value, or fitness for purpose, and you should get an independent mechanical inspection before committing to a purchase of significant value, particularly where the Service has flagged a safety_critical or walk_away item or recommended one.

Nothing in this clause limits any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law (see clause 12).


3. Recall and PPSR results — what they do and do not tell you

3.1 Vehicle recalls. Shufti checks the vehicle's make/model/year against the Australian government's public recall register (vehiclerecalls.gov.au). A recall being listed for that make/model/year does not confirm that the specific vehicle you are looking at has, or has not, had that recall rectified. You should ask the seller or a dealer to confirm rectification history directly.

3.2 PPSR checks. Where you explicitly request a paid PPSR (Personal Property Securities Register) search, Shufti obtains a search of the Personal Property Securities Register against the vehicle identifier you provide (VIN or registration number) at the time the search is run. This is a point-in-time search of that specific identifier only, not an ongoing monitoring service, not a guarantee that the vehicle is free of any interest, and not a substitute for your own independent checks. A search result that shows no registered interest at the time of search reflects only the register's contents at that moment against the identifier searched, and PPSR search certificates are themselves subject to the Australian Government's own terms of use.

We do not guarantee the accuracy, completeness, or currency of any recall or PPSR data. These are third-party government data sources supplied to you as-is.


4. Not a scam or fraud-detection service

The Service may surface signals that a listing or seller's behaviour looks unusual (for example, in the negotiation or guidance features). Any such signal is a prompt for you to investigate further — it is not an accusation of fraud, dishonesty, or wrongdoing by any seller, and it is not a legal or factual conclusion about the seller or the listing. Shufti does not verify sellers' identities or intentions and makes no representation about any seller's honesty. You should exercise your own judgement, including by meeting in a safe public place, verifying the seller's identity where practical, and walking away from any transaction that makes you uncomfortable.


5. Photos, audio, and data you provide

5.1 What we collect and why. To generate your inspection checklist, guide you through a walkthrough, and produce your report, the Service collects photos and short clips you capture, any audio clips you record and attach to a check, the written answers you give during the walkthrough, the listing information you provide, and the findings and outcomes recorded during your use of the Service. Our Privacy Policy explains this in full; this clause covers your licence and consent as it relates to your use of the Service.

5.2 Licence you grant us. You own the photos, clips, and other content you capture using the Service ("your content"). By using the Service, you grant Shufti a worldwide, royalty-free, non-exclusive licence to host, store, process, reproduce, and use your content for the purposes of:

(a) operating and providing the Service to you (generating your checklist, walkthrough, findings, and report, and maintaining your Garage history); and

(b) subject to clause 5.3, improving the Service and training or evaluating the models that power it.

5.3 Model-training use and your opt-out. We may use your content, your written walkthrough answers, findings, and outcomes to improve the Service and to train or evaluate the AI models it relies on. This is a genuinely separate use from clause 5.2(a) and we treat it as such:

We aim to remove or filter out identifiable third-party information (see clause 6) from any training use, but this is a mitigation, not a guarantee — see clause 6.

5.4 Retention and deletion.

5.4.1 Retention Period. We only retain your personal information and app usage data for as long as necessary to fulfill the purposes outlined in our Privacy Policy, provide you with our services, or comply with our legal, financial, and statutory obligations under Australian law (including the Privacy Act 1988 (Cth)).

5.4.2 Account Inactivity. If your account remains inactive for a continuous period of twenty-four (24) months, we reserve the right to treat your account as abandoned. Following this period, we will systematically delete or permanently de-identify your personal data in accordance with Australian Privacy Principle (APP) 11.2, unless we are legally required to retain it.

5.4.3 User-Requested Deletion. You may request the deletion of your account and associated personal data at any time via the account settings menu within the App or by contacting our Privacy Officer at support@shufti.io. Upon receiving a valid request, we will take reasonable steps to securely destroy or permanently de-identify your personal data from our active production systems within thirty (30) days, subject to clause 5.4.4.

6. Photos may capture other people — your responsibility, and ours

Inspections happen at a seller's home or business, often in public view of neighbours, other vehicles, and passers-by. You are responsible for taking photos responsibly — please avoid capturing other people, their number plates, house numbers, or other identifying information where you can reasonably do so, and be mindful that you may be on someone else's property.

We apply mitigations of our own aimed at reducing the amount of identifiable third-party information that ends up in the Service or in any training use, including minimising what we ask you to capture and filtering images for identifiable faces or number plates before any such use. These mitigations reduce risk; they do not eliminate it, and we do not guarantee that no third-party personal information will ever be captured, stored, or processed.


7. Purchases, credits, and refunds

7.1 What you're buying. Shufti sells vehicle check credits. One credit is consumed each time you add a vehicle to evaluate. Credits are sold as:

(Current as at the date on the in-app paywall; prices may change — see clause 7.5.) A credit entitles you to one vehicle evaluation (checklist, guided walkthrough, findings, and negotiation report for that vehicle). A credit does not separately entitle you to a PPSR search — where a PPSR search carries its own cost, this is disclosed to you before you request it.

7.2 Credits don't expire. Unless we tell you otherwise at the time of purchase, credit balances do not expire and carry over across purchases.

7.3 Promo and offer codes. We may issue promotional codes that grant credits without payment. These are redeemed through the App Store's or Google Play's own code-redemption mechanism, inside the in-app purchase sheet; conditions, expiry dates, redemption limits and eligibility are set and enforced by the relevant store. Shufti does not operate its own code-entry field.

7.4 How purchases are made — Apple and Google as sellers. On iOS and Android, purchases are transacted through Apple's App Store or Google Play using their in-app billing systems (StoreKit 2 / Play Billing), under Apple's and Google's own terms and refund policies. Shufti verifies every purchase with the relevant store before granting credits, and a given purchase can only be redeemed once, by one account. The web version of the Service does not currently support live payment and purchases are not available there.

7.5 Refunds and the Australian Consumer Law. Credits are digital, consumable purchases and, other than as required by law, we do not offer refunds once a credit has been used to evaluate a vehicle. This does not affect, and is not intended to exclude, restrict, or modify, any consumer guarantee that applies to you under the Australian Consumer Law and that cannot lawfully be excluded. If the Service fails to be of acceptable quality or fit for its disclosed purpose in a way the law does not allow us to exclude, you may be entitled to a remedy regardless of the "no refund" position above. Where your purchase was made through Apple or Google, refund requests are ordinarily handled by that store in the first instance; you may also contact us and we will assist in good faith.

7.6 Price changes. We may change our prices from time to time. Changes will not affect credits you have already purchased. The current price is always shown on the in-app paywall before you buy.


8. Your safety during a physical inspection

The Service's guided walkthrough may direct you to inspect parts of a vehicle including, without limitation, the engine bay while the engine may be running or recently run, underneath the vehicle, and inside wheel arches. Some of these areas can be hot, involve moving parts, or involve pressurised systems.

You are solely responsible for your own physical safety during any inspection or test drive. The Service does not instruct you to use, and you should not use, jacks, ramps, or other tools to access areas of a vehicle unless you are qualified and equipped to do so safely. If a checklist item cannot be safely assessed without such equipment, skip it and note that it could not be checked.

If the walkthrough or a seller invites you to test drive the vehicle, you are solely responsible for:

The Service is designed to withdraw its walkthrough prompts entirely while you are actively driving, but you must not use your phone in a way that breaches road rules in your state or territory, regardless of what the Service prompts. If in doubt, pull over safely before interacting with the app.


9. Listing information and third-party websites

You may use the Service to paste in a URL from a vehicle listing on a third-party website (for example carsales.com.au, gumtree.com.au, or ebay.com.au). The Service renders the publicly available listing page you link to within the app on your own device, the same as opening it in a mobile browser, and reads the displayed page to extract vehicle details (make, model, year, price, and similar fields) for your use of the Service. Nothing in the Service is intended to breach the terms of service of any listing website.

You are responsible for how you use listing data obtained through the Service, and for complying with the terms of service of any third-party website you visit or interact with in connection with your use of the Service. We are not responsible for the accuracy, availability, or content of any third-party listing or website.


10. Acceptable use

You must not use the Service to:

We may suspend or terminate your account, without refund of any unused credit balance where suspension or termination follows your breach of these Terms, if we reasonably believe you have breached this clause.


11. Intellectual property

11.1 Our IP. Shufti owns all rights in the Service, including its software, algorithms, checklists, scoring methodology, report templates, and branding. Nothing in these Terms transfers any of that to you. You may not copy, reverse-engineer, or create derivative works from the Service except as the law expressly allows despite this restriction.

11.2 Your content. As between you and Shufti, you retain ownership of the photos, clips, and other content you capture using the Service. You grant us the licence described in clause 5 to operate and improve the Service. You confirm you have the right to grant us that licence in respect of everything you upload.


12. Liability

12.1 Consumer guarantees. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you under the Australian Consumer Law (or any other law) that cannot lawfully be excluded, restricted, or modified. Where our liability for a failure to comply with a consumer guarantee may lawfully be limited, our liability is limited, at our option, to re-supplying the relevant part of the Service or paying the cost of having it re-supplied.

12.2 To the extent the law allows. Subject to clause 12.1, to the maximum extent permitted by law:

(a) the Service is provided "as is" and we do not warrant that it will be uninterrupted, error-free, or that any estimate, score, or suggested offer will be accurate;

(b) we exclude all conditions, warranties, and representations not expressly set out in these Terms; and

(c) our total liability to you arising out of or in connection with the Service, however arising, is limited to the amount you paid us for credits in the 12 months before the event giving rise to the claim.

12.3 What we are not liable for. Subject to clause 12.1, we are not liable for any decision you make to buy, not buy, or negotiate on any vehicle, for the condition of any vehicle, for any loss arising from a transaction between you and a seller, or for any third-party data source (including recall registers and PPSR results) being inaccurate, incomplete, or out of date.


13. Indemnity

To the extent permitted by law, you agree to indemnify Shufti against any loss, damage, cost, or expense we reasonably incur arising from your breach of these Terms, your misuse of the Service, or content you upload that infringes someone else's rights — except to the extent caused by our own breach of these Terms or negligence.


14. Accounts, guest use, and termination

14.1 Accounts. Some features — including your Garage history of vehicles, reports, and chat history — require an account. You are responsible for keeping your login credentials secure and for all activity under your account.

14.2 Guest use. You can browse parts of the Service — including the Home screen — without creating an account ("Continue without an account"). Adding a vehicle, running a checklist walkthrough, requesting a PPSR search, making a purchase, or anything else that requires the Service to identify you needs a signed-in account. Nothing you do in guest mode is saved to a Garage history, because a Garage requires an account to exist.

14.3 Termination. You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have breached these Terms, if we're required to by law, or if we discontinue the Service, with notice where reasonably practicable. Termination does not entitle you to a refund of any credit balance except where clause 7.5 or the law requires one.


15. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service, our pricing, or the law. Where a change is material, we will take reasonable steps to notify you (for example, an in-app notice) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you don't agree with a change, you should stop using the Service.


16. Disputes

If you have a concern, please contact us first at support@shufti.io so we can try to resolve it informally. If we can't resolve a dispute this way, you may have rights to raise it with the ACCC, your state or territory fair trading or consumer affairs body, or another applicable regulator, and nothing in these Terms limits your ability to do so.


17. Governing law

These Terms are governed by the laws of Victoria, Australia, and you and Shufti submit to the non-exclusive jurisdiction of the courts of Victoria.
